  1. Dates/Terms/Eligibility. Underground Music (“Underground”) may change the dates and/or terms of the Contest without prior notice. Any material changes will be posted on its website. Contest starts July 5 2017. The Contest is open to legal Canadian residents, residing in British Columbia. There is no purchase necessary to enter or win. Employees or agents of Underground or any entity (Bob Masse Studios, Opus Art Supplies, Wentworth Music) associated with the Contest, as well as members of the same household of any such employee or agent, may not participate.

 

  1. Prizes. All sales, prize and other taxes, gratuities and any other incidentals associated with the prize are the sole responsibility of the prizewinner. Prizes are not transferable or exchangeable and may not be substituted, except by Underground for reasons of unavailability. In which case, a prize of equal or greater value will be awarded. Underground assumes no responsibility or liability for damages loss or injury resulting from acceptance or use of the prize. Underground is not responsible for replacing tickets in the event of show cancellations as a result of weather, promoter or performer.

  1. How to Enter: Follow the instructions below to submit the ‘Entry’ of your Artwork or Video. Only Entries submitted between 12:00:01 AM PDT on July 5, 2017 and 11:59:59 PM PDT on July 20, 2017 will be eligible. You may submit multiple Entries, but each Entry must be a picture of a different Artwork and a different Video link. Each entry must include your name via profile link to Facebook, Instagram or YouTube. Finalists will be contacted via private message (Messenger) for telephone and email address. Your entry signifies you have read, understand and agree with the Official General Contest Rules!

 

‘Bob Dylan Poster Design Contest’ (Artwork) and Entry Requirements:

Create an original piece of visual art that is inspired by your imagination (your “Artwork”). The Artwork may not be a reproduction of any existing work. Artwork must be designed in the stylings of iconic poster artist Bob Masse, ie the ‘Art Nouveau’ movement and the work of Alphonse Mucha in particular. Samples can be found at Bob Masse Studios or at Underground Music at 1331 Ellis Street, Kelowna, BC. Artwork to be 11” x 17” OR 8” x 12”. The following text must be incorporated into the design:

Once your Artwork is complete, take a high-resolution picture of your Artwork. The picture will constitute your “Entry.” The Entry must be in JPEG, PDF or other transferable format and posted on designated Underground Facebook Contest Post, Underground Instagram Contest Post and / or Underground Website. The link / video will constitute your “Entry.” Artwork must be received no later than July 20 2017.

 

‘Bob Dylan Impersonation Contest’ (Video) and Entry Requirements:

Create an original video that is inspired by your interpretation of Dylan’s music; it may include your sense of humour (your “Video”). The Video must be Bob Dylan Cover Music only. Instruments may include guitar and/or harmonica, and vocals or vocals only. The Video must be a minimum 30 seconds in length to a maximum of 60 seconds in length. Once your Video is complete, create a link of your YouTube video and post on designated Underground Facebook Contest Post, Underground Instagram Contest Post and / or Underground Website. The link / video will constitute your “Entry.” Video must be received no later than July 20 2017.

 

  1. Underground’s Rights to Entries: You do not transfer ownership of your Artwork or Video by entering the Contest. However, by entering, you give Underground certain rights to use the photo of your Artwork or (link to) your Video (your “Entry”) for the purpose of promoting you and the Contest. Specifically, you: (a) irrevocably grant Underground, its agents, licensees, and assigns the unconditional and perpetual exclusive right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, exhibit, and otherwise use the photo of your Artwork or Video (your “Entry”) for the purpose of promoting you and the Contest in any media throughout the world in relation to the Contest (and future versions of the Contest), without additional review, compensation, or approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude Underground’s use to use the photo of your Artwork or Video (your “Entry”) for the purpose of promoting you and the Contest, or require any further permission for Sponsor to use the Entry; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Sponsor on the grounds that any use of the photo of your Artwork  or Video (your “Entry”) for the purpose of promoting you and the Contest, or any derivative works, infringes any of your rights as creator of the photo of your Artwork or Video (your “Entry”), including, without limitation, copyrights, trademark rights, and moral rights. Wherever possible, you will be credited as the creator of your Artwork or Video.

 

 

  1. Conditions/Restrictions. Each winner will be required to produce identification satisfactory to Underground. Each winner will be required to sign an affidavit of eligibility and release, including a publicity release, as prepared by the Underground prior to receiving their prize. Each winner will be responsible for any taxes or fees that result from the receipt and/or use of their prize. The Contest is void where prohibited by law. Anyone using fraudulent means to participate and/or win the Contest will be disqualified. You further agree to indemnify, release, and hold the Released Parties harmless from any Claims that their use of your Entry or Artwork (as contemplated herein) violates or infringes upon the rights of any third party.

 

  1. Special Internet Rules. Underground is not responsible for errors, problems or delays in the uploading video or images to social media accounts or website that may prevent entries from reaching Underground. Underground is not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by Underground, users, by any equipment or programming utilized in promotions, games or contests, or by human error.

Underground reserves the right, in its sole discretion, to cancel or suspend a promotion, game or contest should a virus, bug, computer or other problem beyond the control of Underground corrupt the administration, security or proper execution of any Internet promotion, game or contest, or the Internet portion of any promotion, game or contest. Underground, in its sole discretion, may award prizes to entries received by alternate means. All Internet participants agree to be bound by these rules, and the Official General Rules appearing above.

 

  1. Judging. Decisions of the judges are final. Judging Panel may include, but is not limited to: Bob Masse (Bob Masse Studios), Aaron Metz (Opus Art Supplies), Noel Wentworth (Wentworth Music), Joe and Paula Thompson (Underground Music). Winners will be announced July 22 2017.

Judging Panel will review all Entries submitted according to the following Judging Criteria (weighted equally): (i) Line; (ii) Composition; (iii) Creativity & Uniqueness; (iv) Execution of Medium & Difficulty of Process; and (v) Original Work. The judges will select up to 10 Finalists.

 

  1. Winners: The names of the winners will be posted on Underground’s Social Media Accounts, Website, and in the Retail Location.

Potential Winner Requirements: In order to win a prize, a potential winner may be required to complete and return the following documents: (a) a declaration of eligibility and release. This does not affect a potential winner’s rights to the underlying Artwork. If a potential winner fails to sign and return the documents within five (5) days of the date the documents are mailed or presented, he/she will forfeit the prize and an alternate potential winner may be selected in his/her place according to the Judging Criteria.

 

  1. Release and Indemnification. In exchange for the right to participate in the Contest, each participant agrees to release and indemnify Underground, and its officers, directors, agents, parent companies, subsidiaries and employees (the “Released Parties”), from any and all claims, demands and/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that arise out of the participant’s participation in the Contest.

 

  1. Rules. Any violation of these rules will result in disqualification. Copies of these rules are available at Underground’s Website, in person at the retail location (#4 – 1331 Ellis Street, Kelowna, BC. V1Y 1Z9) during regular business hours (daily; according to hours posted on website / Facebook) or by sending a request, along with a self-addressed stamped envelope, to the Underground at this address.
